ARTICLE 1. SCOPE OF APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale apply without restriction or reservation to all purchases of services (the “Services”) offered by ICC - LA TOISON D’OR (the “Service Provider”) to consumers and non-business customers (the “Customers” or the “Customer”) through its website www.riviera-villages.com (the “Website”).
The main characteristics of the Services and their specific terms and conditions are presented on the Website.
The Customer must read these terms and conditions before placing any booking. The choice and purchase of a Service are the sole responsibility of the Customer.
These terms and conditions apply to the exclusion of all other terms and conditions, particularly those applicable to other sales channels for the Services.
They may be supplemented by specific terms and conditions stated on the Website before any transaction with the Customer.
These General Terms and Conditions of Sale are available at all times on the Website and shall, where applicable, prevail over any other version or contradictory document.
Unless proven otherwise, the data recorded in the Service Provider's computer system shall constitute evidence of all transactions concluded with the Customer.
The Customer declares that they have read and accepted these General Terms and Conditions of Sale by ticking the relevant box before starting the online booking procedure described below.
Confirmation of a booking by the Customer constitutes unreserved acceptance of these General Terms and Conditions of Sale.
The Customer acknowledges that they have the legal capacity required to enter into contracts and purchase the Services offered on the Website.
As these General Terms and Conditions of Sale may subsequently be amended, the version applicable to the Customer's purchase shall be the version in force on the Website on the date the booking is made.
These General Terms and Conditions of Sale take effect on 1 November 2026.
Amendments to these General Terms and Conditions of Sale shall be binding on Website users from the date they are published online and shall not apply to transactions concluded previously.
ARTICLE 2. BOOKING A STAY AND PAYMENT
The Customer selects the Services they wish to book on the Website.
To obtain full information about the Services offered, the Customer may consult the catalogue of Services on the Website or request an explanation from the Service Provider's reservations team by telephone on [00.33.4.94.79.83.54] or by email at [toison@riviera-villages.com].
The Customer determines which Services they wish to book at the time of booking.
By confirming the booking, the Customer acknowledges the content of the Services, the destination, the price, the booking arrangements and all the characteristics of the stays and accommodation.
The Customer therefore acknowledges having requested and obtained all the information necessary to make their booking with full knowledge of the relevant details and under their own responsibility.
The booking is registered on the Website when the Customer accepts these General Terms and Conditions of Sale by ticking the relevant box and confirms the booking. Such confirmation implies acceptance of all these General Terms and Conditions of Sale and constitutes evidence of the sales contract.
The booking shall only be considered final once:
- The Service Provider has emailed the Customer confirmation of acceptance of the booking; and
- The Customer has made payment in accordance with the terms applicable to their chosen offer.
The Customer undertakes not to establish their residence at LA TOISON D’OR and not to carry out any professional activity within LA TOISON D’OR.
ARTICLE 3. PRICES AND PAYMENT TERMS
A. Prices
The Services offered by the Service Provider are supplied at the prices in force on the Website.
The prices of the Services are stated in euros (€), inclusive of VAT at the applicable statutory rate.
Tourist tax is not included in the price. Tourist tax applies to persons aged 18 and over, at the rate in force in Ramatuelle at the time of the stay, per night and per person aged 18 and over.
Our VAT-inclusive prices may be amended if the tax rates applicable to our stays increase.
Prices take account of any discounts or promotions granted by the Service Provider under the conditions specified on the Website.
These prices are fixed and final on the booking date.
The Service Provider specifies that prices are dynamic and change throughout the season, allowing the Customer to benefit from the most advantageous price available on the day of booking.
The displayed price, preceded by the words “from”, is the lowest available price during the establishment's opening period.
This price may be increased based on a combination of two criteria:
- Depending on the booked period and the establishment's occupancy level, a dynamic multiplier specific to each period shall be applied.
- Booking in advance provides a price advantage, although this cannot reduce the price below the reference rate (the displayed price).
In view of the foregoing and the Customer's active role in determining the rate applicable to their stay, which depends on how far in advance the booking is made, ICC - LA TOISON D’OR may under no circumstances be held liable for a difference in price between two stays booked for the same period.
B. Payment terms and methods
Payments shall only be made through secure payment channels using the following methods:
- Bank or credit card: Carte Bleue, Visa, MasterCard or American Express.
- Bank cheque. Cheques not sent by registered post and not received by LA TOISON D’OR remain the Customer's responsibility.
- Bank transfer.
- Digital or electronic French holiday vouchers only, also known as Chèques-Vacances Connect. Paper Chèques-Vacances Classic are not accepted as a means of payment. No change shall be given if the total value of the holiday vouchers exceeds the total booking price. Payment by holiday vouchers cannot retrospectively replace a payment already received by bank card, credit card or bank cheque.
Payment by bank or credit card is irrevocable, except in the event of fraudulent use of the card. In such cases, the Customer may request cancellation of the payment and reimbursement of the corresponding amounts.
Where payment is made by bank cheque, the cheque must be issued by a bank established in mainland France or Monaco.
Cheques are presented for collection upon receipt.
Any late payment shall automatically result in a fixed compensation charge of forty (40) euros. Furthermore, if the above payment terms are not complied with, the Service Provider reserves the right to cancel the provision of the Services booked by the Customer.
Payments made by the Customer shall only be considered final once the Service Provider has actually received the amounts due.
Every payment must include the booking reference shown on the Service Provider's booking confirmation.
Payments are arranged as follows:

In accordance with Article L.221-28, paragraph 12, of the French Consumer Code, this right does not apply to contracts for accommodation services to be provided on a specific date or during a specific period.
A. Cancellation by the Service Provider
In the event of cancellation by the Service Provider, except in cases of force majeure, the Service shall be refunded by bank transfer within 60 days of cancellation by the Service Provider.
Such cancellation shall not give rise to any payment of damages or compensation.
Nevertheless, provided that applicable legislation permits it, the establishment reserves the right to reimburse the Customer by another method, particularly by issuing a credit voucher.
B. Cancellation by the Customer
To be taken into account, any cancellation must be notified to the Service Provider by email or registered letter with acknowledgement of receipt.

Standard Package
This applies to bookings that do not have a specific offer designation at the time of booking.

Where a refund is due following cancellation by the Customer, and except in cases of force majeure, the establishment shall refund the Customer by bank transfer within 60 days of the cancellation.
Nevertheless, provided that applicable legislation permits it, the establishment reserves the right to reimburse the Customer by another method, particularly by issuing a credit voucher.
ARTICLE 5. AMENDMENTS TO THE BOOKING
The Customer may request a change to their booking, including dates and/or accommodation type, up to a maximum of 48 hours before the start of the stay, by submitting a written request to the Service Provider (by post or email), subject to availability and feasibility.
No postponement to the following season shall be accepted.
If the booking cannot be amended, the Customer must either complete the stay under the original booking conditions or cancel it in accordance with the cancellation conditions set out above.
Any request to extend the stay shall be subject to availability and to the rates in force on the date the amendment is requested.
Any request to shorten or change the duration of the stay shall be considered a partial cancellation and shall be subject to the cancellation conditions.
For the purposes of applying these conditions, the stay is considered a single, indivisible booking that cannot be split or divided.
IMPORTANT: No refund shall be granted for a shortened, interrupted or reduced stay (late arrival or early departure), or for any Service not used.
ARTICLE 6. ARRANGEMENTS DURING THE STAY
A. Arrival and departure
Arrival days vary depending on the period and type of booking.
Check-in is available from 4.00 pm on the scheduled arrival day, subject to presentation of valid proof of identity.
A passport or national identity card shall be accepted as valid proof of identity. Where payment has been made by bank or credit card, the identity document must belong to the cardholder.
Motorhomes, caravans and other types of vans (minibuses and campervans) are prohibited within the grounds of the outdoor hospitality establishment. They must be parked in the area designated by the establishment upon the Customer's arrival.
On the departure day, rental accommodation must be vacated before 10.00 am.
Late check-out is available only subject to availability and must be arranged on the day before departure:
- For €50: Provided that late check-out has been booked and paid for at reception on the day before departure, the Customer may vacate the rental accommodation no later than 12 noon.

B. Security deposit
A security deposit equal to 25% of the rental price must be paid by the Customer to the Service Provider upon arrival, by bank or credit card or by cheque.
The payment method must belong to one of the persons actually staying at the establishment, who must provide valid proof of identity.
The security deposit shall be returned to the Customer on the departure day following a full inspection and inventory check of the rental accommodation.
Management reserves the right to retain all or part of the security deposit in the event of failure to comply with hygiene requirements and/or damage to the rented equipment or furnishings.
If the Customer leaves outside reception opening hours, the rental accommodation shall be inspected at a later time and the security deposit returned by post.
Retention of the security deposit does not exclude additional compensation where the costs incurred exceed the amount of the deposit.
C. During the stay
I. HOUSE RULES AND CUSTOMER OBLIGATIONS
The establishment's house rules are displayed on the Service Provider's premises.
All Customers must comply with the provisions of the house rules.
Furthermore, each Customer is personally responsible for any disturbance or nuisance caused by persons staying with them or visiting them.
Each rental accommodation is intended for a specified number of occupants and must under no circumstances accommodate more persons than its authorised capacity.
The Customer may not transfer this contract to another person without the Service Provider's prior written consent.
Minors must be accompanied by their parents or legal guardians.
Electric vehicles belonging to the Customer must be charged exclusively using the designated free or paid electrical sockets and charging stations indicated or provided by the Service Provider.
In the event of violent or inappropriate behaviour, insulting and/or racist remarks, verbal or physical aggression or, more generally, any serious and/or repeated breach of the establishment's house rules, the Service Provider reserves the right to require the Customer to leave the establishment.
No refund of any kind shall be granted in such circumstances.
If damage is identified after the Customer's departure (breakages, theft, failure to comply with contractual conditions or hygiene and cleanliness requirements, deterioration), management reserves the right to charge the Customer the additional costs incurred and necessary to restore the rental accommodation to its original condition, including replacement equipment, additional cleaning and repairs.
For safety and insurance reasons and in accordance with applicable standards, each accommodation unit has a strict maximum occupancy capacity.
Every person, including children and babies from birth, counts as one full occupant.
The identity of all occupants must be provided at the time of booking and confirmed before arrival. Only declared persons are authorised to stay at the establishment.
If, upon arrival or during the stay, the number of occupants exceeds the maximum authorised capacity of the booked accommodation, the establishment reserves the right to:
- Refuse access to undeclared persons or persons exceeding the authorised occupancy.
- Transfer the booking to accommodation with a greater capacity, subject to availability and payment of the price difference.
If it is not possible to transfer the Customer to accommodation with a greater capacity, particularly when the establishment is fully booked, and the Customer refuses to comply with the maximum authorised occupancy, the accommodation contract shall be terminated immediately due solely to the Customer's breach.
In such circumstances, the Customer shall not be entitled to any refund or compensation.
II. LOSS, THEFT AND DAMAGE
The Service Provider shall not be held liable for the loss, theft or damage of personal belongings during the stay, whether in rental accommodation, car parks or communal areas.
Consequently, the Service Provider disclaims all liability in cases of theft, fire, adverse weather conditions and similar events, or incidents falling within the Customer's civil liability.
The Service Provider also disclaims liability for the tenant's valuables, belongings and personal possessions, particularly those kept in the safes provided in rental accommodation.
These safes are made freely available to the Customer and are used under the Customer's sole responsibility.
Customers are advised to contact their insurance provider to arrange any necessary extension of their personal insurance cover.
Where the Service Provider makes additional equipment, facilities or items available in the Customer's accommodation, the Customer expressly acknowledges responsibility for their proper use and for keeping them in good condition.
The Service Provider asks the Customer to bring these items inside the accommodation both during the stay and on the departure day.

The Customer acknowledges having read the conditions of use of the parasol, namely that it may only be used on the terrace of their accommodation.
Any other use of the parasol, particularly on the beach, shall result in the establishment retaining the security deposit paid at the time of reservation.
In the event of damage, loss or theft of the parasol and/or protective cover, the Customer shall be solely responsible.
In such cases, the security deposit shall not be returned to the Customer and shall be retained by the Service Provider.
The Customer acknowledges having been fully informed of these conditions.

In accordance with statutory provisions, the Service Provider undertakes to ensure that its Services comply with the applicable regulations.
The Customer expressly acknowledges that the Service Provider cannot be held liable for inaccurate information communicated by partners or third parties and appearing in the brochure or on the Website concerning the accommodation sites.
This includes, in particular, photographs, descriptions, activities, leisure facilities, amenities, Services and operating dates.
All photographs and text used in the brochure or on the Website are non-contractual and provided for information purposes only.
Certain activities and facilities offered by the Service Provider and described in the brochure or on the Website may be withdrawn, particularly due to requirements imposed by an administrative authority, the implementation of a health protocol, safety considerations, the precautionary principle or force majeure as defined by the French courts.
The Service Provider shall be exempt from liability where non-performance or improper performance of the contract is attributable to the Customer, to an unforeseeable and unavoidable act of a third party unrelated to the provision of the contractual Services, or to force majeure as defined in Article 1218 of the French Civil Code (Code civil).
Where a private hot tub or swimming pool is provided within the rental accommodation, the Service Provider reminds the Customer that the private hot tub or swimming pool is not supervised.
Customers are strongly advised to exercise particular care to avoid any risk of drowning.
Before using the hot tub, the Customer must ensure that they have no medical contraindications to its use.
The Customer must also ensure that they have the knowledge necessary to operate and adjust the hot tub.
The Customer remains solely responsible for the correct use of the hot tub or swimming pool provided.
In the event of improper use of the facilities, the Customer must cover the costs of repairs and/or restoration.

ARTICLE 11. CONSEQUENCES OF AN INVALID OR UNENFORCEABLE PROVISION
If any article or clause of these General Terms and Conditions of Sale is declared invalid or deemed unwritten, this shall not affect the validity or enforceability of the remaining provisions.
